1. Operator and scope
Phở ơi is a product of Phooi Inc., a California company in the United States. “We” means Phooi Inc.; “you” means a visitor, person contacting us or service user. Send personal-data requests to [email protected].
This policy covers phooi.com and Phở ơi promotional pages we operate, information you send us, and the app when released. Business services may have separate processing notices or agreements. Third-party policies apply when you leave our website to use their services.
2. The current website and upcoming features
The current website introduces the product. It does not access your microphone or camera, record audio, offer a voice trial, create accounts or process payments. Interface images and use cases illustrate planned features, not live service sessions.
This website version has no newsletter or business inquiry form. Selecting an email contact link opens your email application; we receive information only if you send a message. The account, voice, calling and integration provisions below apply only when the corresponding feature is introduced and you use it.
3. Information you choose to provide
When contacting us, you may provide your name, email address, telephone number, company, role, industry, needs and correspondence. We use this information to respond, support you or discuss cooperation. An inquiry email is not automatically a marketing subscription.
If a signup form is introduced, required and optional fields will be distinguished, its purpose explained and marketing consent collected separately where necessary. Do not send passwords, verification codes, complete card numbers or unnecessary sensitive information.
4. Technical data, cookies and device storage
When the website loads, infrastructure providers may process IP addresses, browser and device information, requested paths, access times and security signals to deliver content, prevent abuse and troubleshoot problems. Infrastructure data is distinct from information you enter into the app.
The current website code saves your VI/EN preference in localStorage under “phooi-language”. It remains in your browser until changed or cleared and is not sent to a server by the website code. Clearing website data in your browser resets this preference.
The current website code does not integrate behavioral analytics, advertising pixels or advertising cookies. Infrastructure may use necessary security mechanisms depending on its configuration. If nonessential technologies are introduced, we will update notices and request your choice or consent where required. The website has no separate response to Do Not Track signals; this does not remove statutory opt-out rights.
5. App information when features become available
Depending on the features used, information may include registration details, username, display name, avatar, biography, settings, in-app contacts, messages, uploaded files, reminders, appointments and support requests. Call information may include participants, time, duration, connection status and technical logs; call information does not mean calls are recorded by default.
The app may need location for directions, images or camera access for visual requests, contacts for connections, or notifications for reminders. Access depends on the feature, its notice and your permissions. We will explain the scope before requesting access; installing the app does not by itself authorize uploading your entire address book or continuously tracking location.
Orders, reservations, appointments and device control may require recipient details, location, time, request contents or device identifiers. Provide only necessary information and check the recipient before confirming.
6. Voice, AI and processing providers
The current website does not listen for or recognize “Phở ơi”. For the future app, microphone permissions, activation, on-device versus server processing, recipients and background operation must be explained before you enable the feature. Do not assume the app always listens or that audio is always processed offline.
Voice features may transcribe audio, send requests to AI systems and generate spoken responses. Necessary data may be transmitted to speech or AI providers to fulfill your request. Whether audio, transcripts or conversation history are retained, and for how long, will be explained in the feature notice before use.
Using the service is not automatically consent to use private conversations for model training for other purposes. If training or improvement beyond fulfilling your request is planned, we will disclose its scope, controls and obtain consent where necessary. Do not submit other people's confidential information or sensitive data you have no right to process.
7. Usernames, profiles and content recipients
A username helps others find, connect with, call or message you. Your display name, avatar, biography and activity status may be visible according to the design and settings disclosed in the app. Check the audience before posting; do not put identity document numbers, home addresses or financial information in a public profile.
Former usernames and change history may be retained as necessary for security, impersonation prevention, complaints or disputes. We do not sell profile information to advertisers.
Recipients may save, screenshot or share copies of content. Deletion from your account does not guarantee deletion of copies controlled by others; the feature will explain the scope of deletion.
8. Purposes and conditions of processing
We process information to respond to inquiries, provide requested features, operate and secure systems, verify identity where needed, detect fraud, handle abuse reports, resolve disputes and meet legal obligations. Marketing communications follow your choices and applicable rules.
Depending on location and activity, processing relies on valid consent, performance of an agreement or circumstances legally permitting processing without consent. We do not treat “legitimate interests” as a general permission to bypass Vietnamese consent requirements. Where another jurisdiction permits that basis, it must be used for an appropriate purpose with consideration of your rights.
We will notify you of material changes of purpose and take required legal steps before processing for a new purpose.
9. Choices and withdrawal of consent
You may refuse device permissions, turn off optional features, change permissions in your phone settings, stop marketing communications or contact us to withdraw consent. Features requiring a permission may not work without it; unrelated available features may remain usable.
Withdrawal does not affect the lawfulness of earlier processing. We may retain some data where a separate legal obligation or basis applies and will explain this where relevant. Your consent does not replace any required consent from other people appearing in recordings, images or content you supply.
10. Data sharing and external links
We do not sell personal data. Necessary information may be provided to infrastructure, storage, email, security, technical support or AI providers when the relevant feature is introduced; to recipients or partners you request; or in response to lawful demands from authorities.
Providers acting on our behalf must have appropriate contractual confidentiality and use restrictions. Social networks, app stores and businesses fulfilling your orders may independently determine processing under their own policies. Roles will be distinguished when integrations are introduced.
In a merger, asset transfer or restructuring, information may be transferred as necessary with appropriate safeguards and notice. Social icons on the website are links to external services; this website does not embed social feeds.
11. Business services
Businesses using Phở ơi must establish a lawful basis for processing customer, employee and partner information they upload, notify affected people and restrict internal access. Depending on the agreement, the business may determine purposes while Phooi Inc. processes on its instructions.
The agreement or data addendum will address roles, data categories, security, subprocessors, rights assistance and data return or deletion. For business-managed accounts, we may coordinate with the business on your request. We remain responsible for processing whose purposes we determine ourselves.
12. Processing locations and international transfers
Phooi Inc. operates in the United States. Information may be processed in the United States, Vietnam or countries where actual providers operate. This policy does not promise that all data is stored in Vietnam.
Before introducing cross-border data flows, we will identify locations, recipients and relevant legal requirements, apply appropriate agreements and safeguards, and complete assessments, documentation or procedures where required. Feature-specific information will be provided when the feature operates.
13. Retention and deletion
We do not keep data indefinitely merely because we can. Retention depends on purpose, data type, duration of the service relationship, security risks and legal obligations. Correspondence is kept as needed for the inquiry and related work; technical logs follow operational needs and applicable infrastructure policies.
Appropriate retention information for accounts and app content will be provided before launch. Unneeded data will be deleted or appropriately anonymized. Backups may be removed according to backup cycles rather than immediately. Data retained for legal obligations, fraud prevention or disputes must have restricted purposes and access.
Send deletion requests to [email protected]. Uninstalling the app does not automatically close your account or delete server data. Account closure instructions and deletion scope will be published when accounts are introduced.
14. Security and incidents
We apply technical and organizational measures appropriate to the data and risks, restrict access, manage providers and address signs of unauthorized access. Specific measures depend on actual systems; this policy does not claim that all content is end-to-end encrypted.
No transmission or storage method guarantees absolute security. Following a data incident, we will assess, contain and remedy the impact and notify affected people or authorities in the circumstances and within the deadlines required by law. Protect your device, do not share verification codes and promptly report unusual activity.
15. Your rights and submitting a request
Depending on applicable law, you may have rights to information about processing; access and copies; correction; consent withdrawal; deletion, restriction, objection or portability where applicable; complaints, protection of your interests and compensation as provided by law.
Email [email protected] with the subject “Privacy request”, your contact details, relevant account or interaction and specific request. Do not include passwords or sensitive identity documents in the initial email. If verification is needed, we request information proportionate to the risk. Representatives may need to show authorization.
We respond within applicable legal deadlines, explain lawful extensions or permitted refusals and provide next steps. You may request reconsideration through the same channel or contact a competent authority. Exercising lawful rights is not a reason to discriminate against you.
16. California residents and other regions
If you are a California resident and processing falls within CCPA/CPRA, additional rights may include knowing and accessing data, correction, deletion, opting out of sale or sharing as legally defined, limiting certain uses of sensitive information and nondiscrimination. Authorized agents may submit requests under applicable rules.
The current website does not implement cross-context targeted advertising or sell/share data for that purpose. If this changes, we will provide notices and opt-outs and process Global Privacy Control signals where required. Being based in California does not mean every CCPA duty automatically applies in every situation.
Mandatory rights under the law where you reside remain protected. Contact us about how to exercise applicable rights.
17. Children and minors
The promotional website is aimed at the general public and does not ask children to create accounts or submit data. People under 16 should not independently submit personal information or register for data-processing features without meeting legal requirements and obtaining parental or guardian consent where required.
Before making the app available to children, we will determine age limits, verification and consent requirements, age-appropriate notices and safeguards. General adult permission does not automatically satisfy every legal requirement. If you suspect inappropriate collection of a child's data, contact us so we can verify, restrict processing and delete where necessary.
18. Policy updates and contact
We will publish updates on this page with a revision date. Material changes will be communicated appropriately; where new consent is required, we will request it before applying the change. This policy does not retroactively validate earlier processing.
Privacy contact: Phooi Inc. — [email protected] — phooi.com. Feature notices will provide additional details before the app or new categories of personal-data processing are introduced.
